On May 14, 2019, Beyond Nuclear's legal counsel, Diane Curran and Mindy Goldstein, wrote a letter to the United States Court of Appeals for the District of Columbia Circuit, re: Beyond Nuclear, Inc. v. NRC, No. 18-1340.

This refers to Beyond Nuclear's legal appeal against the consolidated interim storage facilities for highly radioactive commercial irradiated nuclear fuel, targeted at New Mexico and Texas. Beyond Nuclear's legal argument focuses on the violations of the Nuclear Waste Policy Act of 1982, as Amended, as well as the Administrative Procedure Act, by NRC's processing of the Holtec International and Interim Storage Partners license applications.

Beyond Nuclear's legal counsel's letter rebuts a May 10, 2019 filing by the U.S. federal government, on behalf of the NRC, seeking to delay this appeal as premature.

Curran is a partner at the law firm Harmon Curran Spielberg + Eisenberg in Washington, DC. Goldstein is director of the Turner Environmental Law Clinic at Emory University School of Law in Atlanta, GA.
