On-Site Storage

Currently, all radioactive waste generated by U.S. reactors is stored at the reactor site - either in fuel pools or waste casks. However, the casks are currently security-vulnerable and should be "hardened" while a better solution continues to be sought.

Two dozen groups rebut NEI, supplement comments to NRC on Nuke Waste Con Game

Environmental coalition attorney Diane CurranAn environmental coalition comprised of two dozen organizations, including Beyond Nuclear, today submitted supplemental public comments to the U.S. Nuclear Regulatory Commission (NRC) regarding the agency's court-vacated Nuclear Waste Confidence Decision and Rule. The supplemental comments constituted a rebuttal to comments submitted by the Nuclear Energy Institute (NEI), the nuclear power industry's lobbying arm in Washington, D.C.

The coalition held a press conference today, featuring four speakers: Arjun Makhijani, President of Institute for Energy and Environmental Research, one of the coalition's expert witnesses; Diane Curran of the Washington, D.C. law firm Harmon, Curran, Spielberg + Eisenberg, LLP, a lead attorney for the coalition (see photo, left); John Runkle, an attorney with NC WARN (North Carolina Waste Awareness and Reduction Network), another coalition member; and Phillip Museegas, an attorney with Riverkeeper, and another expert witness for the coalition, of which Riverkeeper is also a member.

States have no confidence in NRC's Nuke Waste Con Game

VT AG William SorrellAs reported by the Rutland Herald, Vermont and New York have filed joint comments with the U.S. Nuclear Regulatory Commission on the agency's Nuclear Waste Confidence Decision and Rule. The Attorneys General of VT and NY, who filed the joint comments, along with the Attorneys General of CT and NJ, were plaintiffs in the original lawsuit, which resulted in the DC Circuit Court of Appeals nullifying NRC's Nuclear Waste Confidence on June 8, 2012. The court then ordered the agency to carry out an environmental impact statement on the risks of long-term storage of high-level radioactive waste at reactor sites, such as Entergy Nuclear's Vermont Yankee and Indian Point near New York City.

The State of Vermont Department of Public Service joined in the VT and NY AG's joint comments. VT's Public Service Board is currently considering whether or not Entergy Nuclear, which has actually sued its three commissioners by name, whether the out-of-state utility deserves a Certificate of Public Good to continue doing business in the Green Mountain State.

State of Vermont Attorney General William Sorrell (pictured, left) stated that "Until the D.C. Circuit’s ruling, the NRC licensed and relicensed nuclear reactors on the assumption that the federal government would take away all of the spent fuel from each reactor site at some defined time, so the NRC never looked at the possibility that the fuel might stay there for years, decades, or even centuries.” He added that NRC has to consider whether licensing new -- and extending the licenses at old -- reactors makes sense in light of the long-term environmental impacts of onsite irradiated nuclear fuel storage, and the uncertainty surrounding the availability of a permanent dumpsite at any point in the future. In the 1980s, the U.S. Department of Energy was eyeing 7 potential sites in Vermont's granite for a national repository, as well as additional sites in neighboring New Hampshire (Hillsboro) and Maine (Sebago Lake).

Sorrell's office will present oral arguments at the Second Circuit Federal Court of Appeals in New York City on January 14th, seeking to overturn a federal district judge's ruling in favor of NRC's rubberstamping Entergy Vermont Yankee's 20-year license extension, despite the laws of the State of Vermont to the contrary.

Both VT and NY are strongly resisting 20-year license extensions at Entergy Nuclear's Vermont Yankee (already rubberstamped by NRC in March 2011, just days after the twin design Fukushima Daiichi Units 1 to 3 GE BWR Mark Is melted down and exploded in Japan) and Indian Point Units 2 and 3 near New York City.

24 Groups: NRC Rushing Nuclear “Waste Confidence” Process, Not Satisfying Court-Ordered Requirements

Critics have long dubbed NRC's "Nuclear Waste Confidence Decision and Rule" a Nuke Waste Con Game. In June, the federal courts agreed.An environmental coalition, including Beyond Nuclear, has asserted that NRC's incomplete "Nuclear Waste Confidence" process should trigger continued suspension of all reactor licensing and re-licensing. Beyond Nuclear has applied the related court victory to challenge the proposed new Construction and Operating License Applications at Fermi 3 in Michigan and at Grand Gulf in Mississippi, as well as applications for 20-year license extensions at Grand Gulf Unit 1 and Davis-Besse in Ohio.

The coalition's press release began:

"In documents filed Wednesday with the Nuclear Regulatory Commission (NRC), a wide range of national and grassroots environmental groups said it would be impossible for the NRC to adequately conduct a court-ordered assessment of the environmental implications of long-term storage of spent nuclear reactor fuel in the two short years the federal agency envisions for the process.

In June 2012, the U.S. Court of Appeals for the D.C. Circuit vacated the NRC’s 2010 Waste Confidence Decision and Temporary Storage Rule and remanded them to the agency for study of the environmental impacts of storing spent fuel indefinitely if no permanent nuclear waste repository is licensed or if licensing of a repository is substantially delayed.  Spent nuclear fuel remains highly dangerous for prolonged periods.  It has long-lived radioactive materials in it that can seriously contaminate the environment and harm public health if released.  Additionally, spent nuclear fuel contains plutonium-239, a radiotoxic element that can be used to make nuclear weapons if separated from the other materials in the fuel.  Plutonium-239 has a half-life of over 24,000 years."

"Reading Radioactive Tea Leaves": Kewaunee reactor to shut down

John LaForge of Nukewatch in Luck, WIJohn LaForge of Nukewatch in Luck, WI (pictured left) has penned an op-ed, "Reading Radioactive Tea Leaves: Without a Buyer for Old Kewaunee Reactor, Owner Chooses Shut Down." In it, he details the many radioactive bullets Wisconsin has dodged, and has not dodged, at Kewaunee, just in recent years, including: "...a 2009 emergency shutdown caused by improper steam pressure instrument settings; a 2007 loss of main turbine oil pressure; an emergency cooling water system design flaw found in 2006; [the August 2006 discovery of radioactive tritium leaking into groundwater, for an unknown period, from unidentified pipes somewhere beneath the reactor complex]; a possible leak in November 2005 of highly radioactive primary coolant into secondary coolant which is discharged to Lake Michigan; a simultaneous failure of all three emergency cooling water pumps in February 2005, etc.".

Regarding high-level radioactive waste, John also wrote:

"...Considering Wisconsin’s nuclear power history, Kewaunee’s extremely hot and highly radioactive waste fuel will need expensive management for decades. The La Crosse Boiling Water Reactor near Genoa, Wis. was closed in 1987, and 25 years later its deadly waste fuel is still there, on the banks of the Mississippi..."

John added: "...Literally endless expenditures will be required to keep Kewaunee’s radioactive wastes contained, monitored and out of drinking water for the length of time the federal appeals courts have declared is the required minimum— 300,000 years..."

Nukewatch has watchdogged Kewaunee for decades. On April 23, 2011, Nukewatch organized a "Walk for a Nuclear-Free Future" from Kewaunee to Point Beach's two reactors -- a distance of seven miles, the same as the distance between Fukushima Daiichi and Daini nuclear power plants -- to commemorate the 25th year since the Chernobyl atomic reactor exploded and burned beginning on April 26, 1986. The event took place just six weeks after the Fukushima Daiichi nuclear catastrophe had begun. Beyond Nuclear's Kevin Kamps took part in the walk, and as a keynote speaker along with Natasha Akulenko, a native of Kiev, Ukraine and surivor of the Chernobyl nuclear catastrophe.

NRC's Nuke Waste Confidence EIS will delay reactor licenses for at least two years!

Cover of Beyond Nuclear's pamphlet "A Mountain of Radioactive Waste 70 Years High"The five Commissioners who direct the U.S. Nuclear Regulatory Commission (NRC) have just ordered NRC Staff to carry out an expedited, two-year long Environmental Impact Statement (EIS) process to revise the agency's Nuclear Waste Confidence Decision (NWCD) and Rule. Critics have charged the NWCD is a confidence game, which for decades has prevented environmental opponents of new reactor construction/operation licenses, as well as old reactor license extensions, from raising high-level radioactive waste generation/storage concerns during NRC licensing proceedings, or even in the federal courts. 

But on June 8th, the U.S Court of Appeals for the D.C. Circuit agreed with a coalition of state attorneys general (from NY, CT, NJ, and VT) and environmental groups (including BREDL, NRDC, Riverkeeper and SACE) that NRC's Nuclear Waste Confidence violated the National Environmental Policy Act. In effect, the court ruling, which NRC decided not to appeal, ordered the agency to carry out a decades-overdue EIS on the risks of extended (for decades, centuries, or forever) high-level radioactive waste storage at reactor sites, if a permanent repository is never opened.

This means at least a two year delay in any finalization of NRC licensing decisions for new reactors, or license extensions at old reactors, until this EIS process and NWCD revision are completed. However, all other aspects of the NRC licensing proceedings can still be finalized and dispensed with in the meantime, taking NRC rubberstamps of reactor licenses right up to the edge, just shy of finalization. Beyond Nuclear has raised Nuke Waste Con Game contentions in opposition to two proposed new reactors (Fermi 3 in MI, and Grand Gulf 2 in LA), as well as to two old reactor license extensions (Davis-Besse, OH, and Grand Gulf 1, LA). An environmental coalition has raised similar contentions against all three dozen new reactor construction/operation, and old reactor extension, licenses across the U.S.

Disconcertingly, the NRC Commissioners' press release announcing this EIS launch also stated: "The Commission said the staff should draw on the agency’s 'long, rich history' with waste confidence determinations as well as work performed by other agencies, such as environmental assessments, technical studies and reports addressing the impacts of transportation and consolidated storage of spent fuel."

This seems to indicate that the NRC has joined with the likes of President Obama's and Energy Secretary Chu's Blue Ribbon Commission on America's Nuclear Future in pushing for "consolidated interim storage" instead of "hardened on-site storage" of high-level radioactive waste. This should come as no surprise, as NRC Chairwoman Allison Macfarlane served on the BRC.

Legislation has already been introduced on Capitol Hill that would launch and fund "consolidated interim storage."U.S. Senate Energy and Natural Resources Committee Chairman Jeff Bingaman will hold a hearing on such legislation on Sept. 12th. Witnesses will include two other members of the BRC -- one of its co-chairmen, General Brent Scrowcroft, and former NRC Chairman Richard Meserve -- as well as Pete Lyons, himself a former NRC Commissioner, and now director of the U.S. Department of Energy's Office of Nuclear Energy, mandated to promote nuclear power, and in fact host agency for the BRC. Another witness is the head of Constellation Nuclear, recently acquired by Exelon Nuclear, which would love nothing more than transferring title -- and liability -- for high-level radioactive waste to the American taxpayer, once it begins moving by road, rail, and/or barge, in unprecedented shipment numbers, toward "consolidated interim storage." The final witness is Geoff Fettus, the nuclear attorney at NRDC who helped lead the environmental coalition's victory at the DC Court of Appeals on June 8th. 

Beyond Nuclear has already issued action alerts against the juggernaut revving its engines on Capitol Hill. We have also joined with the likes of Nuclear Energy Information Service, to hold a "Mountain of Radioactive Waste 70 Years High" conference Dec. 1-3 in Chicago. Kevin Kamps will speak about federal legislative threats on the high-level radioactive waste front, and what you can do about them. The grassroots environmental movement has held off the "Mobile Chernobyl" for 20 years, but this may be the most challenging fight yet in 2013. The Nuke Waste Con EIS also means we have to generate large volumes of public comments, so this conference will be a a launching pad for doing so.
