Safety

Nuclear safety is, of course, an oxymoron. Nuclear reactors are inherently dangerous, vulnerable to accident with the potential for catastrophic consequences to health and the environment if enough radioactivity escapes. The U.S. Nuclear Regulatory Commission, Congressionally-mandated to protect public safety, is a blatant lapdog bowing to the financial priorities of the nuclear industry.

U.S. Nuclear Industry Hid Concerns, Hailed Safety Record as Fukushima Melted

As reported by NBC News's Bill Dedman, the U.S. Nuclear Regulatory Commission's (NRC) Office of Public Affairs defended its own image, as well as that of the nuclear power industry, as its top priority during the first days of the fast-breaking Fukushima Daiichi nuclear catastrophe three years ago. As revealed by internal NRC emails obtained via the Freedom of Information Act (FOIA), NRC went so far as to attack Dedman's own reporting at the time, when he used a little known NRC report published in 2010 to rank the seismic risk at atomic reactors across the U.S. The confusion created by NRC's attack on Dedman's reporting dissuaded other news outlets, including the New York Times, from mentioning NRC's ranking of seismic risks -- of which Entergy Nuclear's twin reactor Indian Point nuclear power plant on the Hudson River near New York City had the worst ranking in the U.S. 21 million people live or work within 50 miles of Indian Point. In 2008, seismologists at Columbia University warned about previously unknown earthquake fault lines near Indian Point.

Coalition files Petition to NRC to strengthen reactor license extension rules due to significant new revelations on a radioactive waste risks

Environmental coalition attorney Diane CurranA Petition for Rulemaking was filed on Feb. 18th by Washington, D.C.-based attorney, Diane Curran (photo, left), as well as Mindy Goldstein of the Emory U. Turner Environmental Law Clinic, to the U.S. Nuclear Regulatory Commission (NRC). The Petition seeks to re-open the License Renewal GEIS (Generic Environmental Impact Statement), in order to consider new and significant information about irradiated nuclear fuel storage impacts that was generated by the NRC Staff during the Expedited Spent Fuel Transfer proceeding, carried out under NRC's Fukushima "Lessons Learned" activities. Curran and Goldstein filed the Petition on behalf of three dozen environmental groups, including Beyond Nuclear.

One of these risks newly recognized by NRC Staff is the contribution of high-level radioactive waste storage pool risks to reactor catastrophes, and vice versa.

NRC staff has also admitted that release into the environment of even a small fraction of the contents of a high-level radioactive waste storage pool could cause the long-term dislocation of more than 4 million people, and could render more than 9,000 square miles of land uninhabitable for long time periods. What would the socio-economic costs of such a catastrophe be? Don't people have the inalienable right to safety, health, and environmental protection?

Also, what are the risks to the environment and non-human biota? Answering such questions is part and parcel of the requirements under the National Environmental Policy Act, as the Petition points out.

The filing urges that no reactor license extensions be approved by NRC until the Petition for Rulemaking has been integrated into NRC's safety regulations.

Davis-Besse: from Hole in the Head, to hole in the containment wall

The Hole-in-the-Head fiasco -- a nearly complete breach of the reactor vessel closure head, or lid -- was the most infamous near-miss to a major reactor accident in the U.S. since the Three Mile Island meltdown in 1979.

Now it has been revealed that Davis-Besse has a hole in its Shield Building wall -- an essential component of the radiological containment structures -- that extends up to 12 inches through its 30-inch width, a full 40% way through. Davis-Besse has operated for over two years, at full power, with this potentially fatal flaw in its Shield Building wall.

The gap or air space was discovered last Thursday, and publicly revealed Friday, during the current Davis-Besse steam generator replacement project, which has breached Davis-Besse's Shield Building for an unprecedented fourth time. The previous three breaches include the pre-operational Initial Construction Opening in the 1970s; the 2002-2004 reactor lid replacement project; and the 2011 reactor lid replacement project. Each breach risks further damaging the Shield Building, where severe cracking was discovered in late 2011. In September 2013, FENOC admitted that the severe cracking is growing worse over time.

The hole in the containment wall begs serious questions about NRC incompetence and/or collusion. The hole is located in the area of the construction opening re-sealed in a great big hurry by FENOC, with NRC's blessing, after the reactor lid replacement in late 2011. Beyond Nuclear and environmental coalition allies officially protested the rush to re-start, as the re-sealing literally covered up the primary evidence of severe cracking under feet of concrete.

FENOC never checked the replacement wall -- as with ultra-sonic, X-ray, or other acoustic techniques -- to make sure it was solid. NRC did not require such tests.

How NRC allowed FENOC to do such a bad concrete pour in 2011, leaving behind such a large gap in the Shield Building wall, boggles the mind. NRC claimed to have had its full resources, in terms of inspectors and oversight, in place at the Davis-Besse site, due to the severe containment cracking in late 2011.

Such obvious incompetence, and perhaps even collusion, by NRC raises very serious concerns about public health, safety, and environmental protection. After all, the Japanese Parliament concluded in 2012 that the actual root cause of the Fukushima Daiichi nuclear catastrophe was not the earthquake and tsunami, but rather the collusion between the nuclear utility, the supposed safety regulator, and elected officials, which left the Fukushima Daiichi site so vulnerable to the natural disaster.

Beyond Nuclear helps lead environmental coalition efforts challenging both the steam generator replacements, as well as FENOC's application for a 20-year (2017-2037) license extension at Davis-Besse. Terry Lodge, Toledo-based attorney, serves as legal counsel for the environmental coalition in both NRC proceedings.

Arnie Gundersen, Chief Engineer, Fairewinds Associates, Inc., serves as expert witness for the coalition in the "experimental" steam generator replacement intervention. Gundersen serves as expert witness for Friends of the Earth on the botched San Onofre 2 & 3 steam generator replacements, which has led to the permanent shutdown of those two reactors -- a multi-billion dollar boondoggle. Gundersen was also instrumental in outing the truth on the fatal cracking in Crystal River, FL's concrete containment, also caused by a botched steam generator replacement, another multi-billion dollar boondoggle. Gundersen has alleged that Davis-Besse's steam generator replacement has taken the same shortcuts on safety, made all the worse by its Shield Building's already very questionable, and worsening, structural integrity.

The coalition launched the challenge against the steam generator replacement in May, 2013, and defended its challenge in June and July -- twice in one month! -- 2013. The NRC Atomic Safety and Licensing Board (ASLB) which heard the intervention quickly dismissed it, without addressing the merits, effectively green-lighting Davis-Besse's shortcuts on safety. Beyond Nuclear has posted the entire docket of the steam generator intervention on its website.

Beyond Nuclear has filed a Freedom of Information Act Request on the gap in the Davis-Besse Shield Building wall.

The Toledo Blade has reported on this story, on Feb. 14 and Feb. 15.

NRC posted an Event Notification Report on Feb. 18, and a Preliminary Notification of Occurrence (PNO) on Feb. 19.

Shamefully, NRC rubber-stamped a 20-year license extension at Vermont Yankee (VY) just days after the meltdowns, explosions, and catastrophic releases of hazardous radioactivity from the identically-designed Fukushima Daiichi General Electric Mark I Boiling Water Reactors, but Vermont forced VY's permanent shutdown anyways! Let's hope that Michiganders (and Michigeese, and Michigoslings) will be inspired by, and follow the model of, their Green Mountain State allies. For one thing, Palisades has the most embrittled reactor pressure vessel in the U.S., at risk of meltdown due to pressurized thermal shock...

Vogtle nuclear loan guarantees drag into fifth round of delays

The photo shows the operating Units 1 and 2, as well as the construction site for proposed new Units 3 and 4.As reported by Platts, and conveyed in a Friends of the Earth press release, the December 31, 2013 U.S. Department of Energy deadline for finalization of the $8.3 billion federal taxpayer backed nuclear loan guarantee for Vogtle 3 & 4 has been extended yet again, for a fifth time, until the end of January, 2014.

As reported by FOE: "Freedom of Information Act requests and litigation revealed that the credit subsidy fee offered to Southern Company ranged from 0.8 to 1.5 percent. The credit subsidy fee is supposed to insulate against default, but the fee offered to Southern Company is woefully inadequate to cover the risks involved in major nuclear construction. According to the Nuclear Regulatory Commission, 32 percent of reactor construction is cancelled before any electricity is produced."

NRC rubber-stamped the Vogtle 3 & 4 combined Construction and Operating License Application (COLA) by a 4 to 1 vote at the Commission level. Chairman Greg Jaczko cast the lone dissent, citing "Fukushima lessons learned" not yet applied to the Vogtle 3 & 4 project. It was the first reactor license application approved since 1978; all approved license applications filed after October 1973 were ultimately cancelled.

Four reactors at one site would be the most of anywhere in the U.S. (only Palo Verde in Arizona still has three reactors operating on a single site), raising the specter of multiple, inter-related reactor accidents, as seen at Fukushima Daiichi.

Watchdog groups have long called for a credit subsidy fee commensurate with the risk of the nuclear new build proposals. Congressional auditors reported several years ago that new reactors, historically, have had a 50% risk of cancellation and potential default. The Vogtle 3 & 4 nuclear loan guarantee puts 15 times more taxpayer money at risk than did the Solyndra loan guarantee scandal, which had a significantly lower risk of default than does Vogtle 3 & 4.

Vogtle 1 & 2 were the poster children for cost overruns in decades past, coming in with a price tag 1,300 percent higher than originally estimated! Vogtle 3 & 4's price tag has also skyrocketed over the past several years.

The only way that Vogtle 3 & 4 have proceeded this far is that Georgia lawmakers made legal what is illegal in most states: the gouging of ratepayers on their electricity bills with "Construction Work in Progress" (CWIP) surcharges for the building of the new reactors. This makes ratepayers unwilling investors, who receive no share of the profits that are made -- at who are put at risk of losing every penny invested, if the project ever goes belly up. Ratepayers in Florida just experienced this at the Levy new build site -- $1.5 billion lost, and nothing to show for it.

Thus, the Vogtle 3 & 4 CWIP and federal loan guarantee subsidies join a half-century of ratepayer and taxpayer subsidies to the nuclear power industry, as documented by Union of Concerned Scientists in 2011, to the tune of tens to hundreds of billions of dollars.

Given the Obama administration offered the $8.3 billion nuclear loan guarantee nearly four years ago, and now this latest delay, concerns continue to mount that the project is a financial house of cards, and will ultimately leave taxpayers holding the bag. Nuclear Watch South has called for taxpayers to express their concerns to decision makers, as has Beyond Nuclear.
